The WHO Constitution is at Odds with the WHO's Attempted Power Grab

The WHO has its own Constitution, which guides and circumscribes what the WHO can do. Let’s look at what it says. https://apps.who.int/gb/bd/PDF/bd47/EN/constitution-en.pdf. The commentary is mine. I am seeking an international lawyer well versed in these documents to help us understand how much wiggle room the WHO has to ignore its own specified procedures and rules. 1. Information Article 1 The objective of the World Health Organization (hereinafter called the Organization) shall be the attainment by all peoples of the highest possible level of health. Article 2 lists the many roles of the WHO, all of which are either advisory or standard-setting, with the exception of the last: (v) generally to take all necessary action to attain the objective of the Organization The WHO Constitution wants the citizens of the world to be informed. The Cambridge dictionary says this means “having a lot of knowledge or information about something. The Collins dictionary says, ”Someone who is informed knows about a subject or what is happening in the world.” Page 1 of the WHO Constitution says: Informed opinion and active co-operation on the part of the public are of the utmost importance in the improvement of the health of the people. Article 2, which lists the functions of the WHO, says in paragraph (q): (q) to provide information, counsel and assistance in the field of health There is no authority given to the WHO to control information or direct nations to censor their citizens. 2. What regulations can the WHO adopt? Article 21 delineates those subjects for which the WHO is authorized to issue regulations. They are limited. The IHR (2005) which is currently in force is in conformance with these guidelines, but the proposed IHR amendments exceed the WHO's authority for issuing regulations. Article 23 states that the WHA can make recommendations to members about any issue in which it has competence, but it fails to say that it can issue regulations over as broad a range of issues. I conclude that the extent of the powers that will accrue to the WHO as proposed in the amendments to the IHR exceed the scope for which the WHO is permitted to issue regulations. Therefore, if the WHO wishes to ask the WHA to approve the amended IHR, it must do so as a treaty, agreement or convention, and not as amendments to the IHR. This would require a 2/3 vote of the WHA. 3. How is the Director-General and his staff allowed to interact with outside organizations? Article 33 says, " He may also establish direct relations with international organizations whose activities come within the competence of the Organization." However, he must not be instructed or unduly influenced by them, according to Article 37. How does this accord with 85% of the WHO budget coming from special interests, not from dues, and with the WHO carrying out activities at the behest of its donors, spending 73% of its budget on earmarked activities, which the WHO does not disclose? We know that the Director-General and other WHO officials meet with "stakeholders" like Bill Gates and the Bill and Melinda Gates Foundation (BMGF) staff often to plan or carry out WHO activities. This may involve funding provided by the BMGF but it may also extend to other activities. For example, when an expert committee was convened to discuss adding hydroxychloroquine to the WHO's Solidarity trial, 5 of the 25 experts on the WHO-convened committee worked for the BMGF. This manner of doing the business of the WHO does not appear to be in accord with Article 37 of the WHO Constitution: 4. How are matters decided by the World Health Assembly (WHA)? Article 19 is clear that conventions and agreements require a 2/3 vote by the WHA, not just those present in the room; nor does it say that abstentions will not be counted in the vote. Article 60 defines how the WHA must vote on "important questions." The range of important questions is not defined, but it includes votes on conventions and agreements. Article 60 furthermore indicates that the WHA will vote with a simple majority to determine what categories of questions will need to be voted on by a 2/3 majority. Articles 59 and 60 specify how votes will occur. Within the WHO Constitution there is no delegation of authority to committees or to consensus processes in lieu of voting by the WHA. Yet decisions on past IHR amendments appear to have been delegated to committees that used a so-called 'consensus procedure' without a vote. 5. Immunity Article 67 points out that all WHO staff and all member state representatives have legal immunity "as may be necessary for the fulfilment of its objective and for the exercise of its functions." Has the broad immunity given to all WHO staff been limited in any way when staff are not fulfilling their official duties? Has this immunity been used to avoid civil or criminal prosecutions? 6. Relations with Other Organizations Articles 70 and 71 imply there are likely to be formal agreements about how the WHO interacts with other organizations. Is there a formal agreement with the EU? Does it explicitly give the EU and WHO the right to negotiate with each other, even though the EU has never been a member or observer of the WHO? They should be ordered to supply offending MRNs Importance: High Barry Young disclosed the information to me. I am a US journalist and published the obfuscated records on the Internet. I told the chief executive of Health New Zealand I'd be happy to VOLUNTARILY remove any record which "would likely have significant and irreparable adverse consequences for individuals and their whanau." They have refused to comply with my request. I request the ERA order them to supply me with the offending records(using the MRN record identifier) and explain how it is possible for the record to be matched to any person, dead or alive, in a way that harms that person. All the records were obfuscated using a ONE WAY randomization algorithm so that the data for a given person cannot be identified. Therefore it is IMPOSSIBLE for any person to identify someone else's record. So a breach of PHI is IMPOSSIBLE. No one has contacted me to remove their record because nobody can find their record because it is unfindable. They need to provide proof to the ERA that there is at least one of the 4M records published on my S3 site that could reveal PHI or could have SIGNIFICANT or IRREPARABLE consequences. Where is that proof? They CANNOT meet that burden. I said I would remove any such record from my website voluntarily. They REFUSED to identify the MRN(s) of any such records!!! They should be ordered by the ERA to identify the MRNs of these records IMMEDIATELY to mitigate damages. If they fail to do that, they should be held accountable for any such harm that their inaction has caused. I can be reached at and would be DELIGHTED to have a RECORDED discussion on this matter if you have any questions. They refuse to engage in dialog to settle this matter. I have NO desire to harm people, but they refuse to provide any evidence of harm. Where is the list of MRNs to be removed and the description of the irreparable harm for each of the records requested? They will not provide this voluntarily. THEY SHOULD BE ORDERED TO PRODUCE THIS LIST IMMEDIATELY SO THAT ANY DAMAGES CAN BE MITIGATED. What they want is to have the entire database taken down to cover their crime. They’ve been killing people and they are unable to explain their own data. Lets start looking at some contradictions in the latest draft of the Pandemic Treaty.

This draft was named "pandemic agreement" to keep us guessing whether it is really the same document or something else This is the official version, the latest draft of the pandemic treaty dated October 30, 2023 that both the developing nations and Pharma did not like. But is there much for we the people to like? The term “infodemic” pops up in Article 1, where it is defined as too much information, false information or misleading information. Why is too much information a problem? Equity is to be at the center of this document, at its heart. Let’s see how long that lasts. Free, unhindered access to accurate information is also right at the start of the document, in its “Objective and scope” section. But these mellifluous phrases didn’t last long. By the time we reach the Article 17, equity has morphed into choosing who will get first dibs on pandemic products. Everyone is not equal after all. After promising free, full and fair access to information in earlier articles above, the WHO treaty yanks freedom of speech away. Everyone has to control infodemics (too much informatin or unwanted information) at the local, regional national and international level. That is some massive censorship project being contemplated…or perhaps already in place. And here, the pandemic treaty promises transparency regarding government contracts for drugs and vaccines. Transparency! What a beautiful word. But guess what? Is a charade. Because this very week, the European Parliament and the Canadian parliament voted to continue to hide the contracts for COVID vaccines from their citizens. What did the Lancet say last January about One Health? That non-human animals are of equal concern as humans. Tedros Talks with forked Tongue.

Here's the evidence. Let's look at a few things he told Agence France Press and The Guardian. What does the draft treaty really say? MERYL NASS JAN 25 I have come to love making powerpoint slides, as they seem to convey ideas better than I can do in just words. You get the idea from the Guardian’s photo and text that Tedros is troubled. Will the treaty (aka agreement) (aka accord) pass? The powers behind the WHO throne knew they could only win if they could outsmart us. And they had the ability to pay for the world’s finest sociopathic lawyers. They had to sneak the bad stuff past us. One way of doing that is to deny it exists. Another is to misrepresent what their proposed documents show. Yet another method is to include contradictory passages in the treaty, and refer back to one claim, without revealing that the opposite claim is also embedded in the treaty. Another method runs through everything the WHO does. Financial guru Max Keiser coined the perfect term for this: Complexification. Deliberately complicate things so they are very hard to unravel and understand. The two WHO documents are completely different, treated differently, yet have many overlapping provisions. It is extremely difficult to keep them straight in your head. And their use of language is deliberately confusing. Tedros routinely claims that one document does not say “X,” when it is the other document that says “X”. Here is the Guardian article. Let’s look at some of the tricks pulled in just one article. https://www.theguardian.com/world/2024/jan/22/global-pandemic-agreement-at-risk-of-falling-apart-who-warns Make it about the children, always. “Plans for a global pandemic preparedness agreement risk falling apart amid wrangling and disinformation, according to the chief of the World Health Organization, who has warned that future generations “may not forgive us”. Projection. Accuse the other side of doing what you are doing, i.e., spreading lies and disinformation. Conflate two very different things. “Tedros said all countries needed the capacity to detect and share pathogens presenting a risk, and timely access to tests, treatments and vaccines.” What he fails to admit is that the treaty and amendments want nations to go out and find potential pandemic pathogens (aka biological warfare agents) all the time, not just during pandemics, and give them to the WHO for wider distribution. This is code for proliferation of biological weapons. If nations actually went along with this plan, I can virtually guarantee hundreds of lab leaks and possibly deliberate biological attacks with these agents. Sharing biowarfare agents is very different than timely access to tests and treatments. Use code, and make it about the children. “He called for a “strong agreement that will help to protect our children and grandchildren from future pandemics”.’ The word strong in this coded context means enforceable. Nations will be obligated to obey the WHO. They must be accountable and compliant, according to the treaty draft. Lie outright, and when challenged, show the claim in the treaty that nations are to remain sovereign, and hide the parts of the treaty that show that nations must cede sovereignty to the WHO. Claim universal agreement with the treaty. “The WHO emergencies director, Michael Ryan, reminded countries how the pandemic “ripped apart our social, economic and political systems and became a multi-trillion dollar problem”. In the midst of major geopolitical conflicts, “this is one thing the world agrees on”, he said.” What is sovereignty? The ability to rule yourself. If you allow someone else to rule you, in whole or part, you are ceding sovereignty over whatever it is they can command. Let’s look at page 20 of the treaty for an example of how sovereignty is to be lost. The WHO requires nations to pass certain laws, using the word shall, which in legal language, in international treaties, means MUST. Article 14 paragraph 1 tells nations they must expedite approvals (i.e., licenses) and authorizations (i.e., EUAs) of pandemic drugs and vaccines. Decoding this, it means nations need to find ways to get drugs and vaccines into their populations without going through full testing and licensing. In the US, an EUA can be issued without testing the product in even one experimental animal. Article 14 paragraph 5 tells nations they must have laws and regulations in place to push pandemic drugs and vaccines out quickly. Article 15 paragraph 1 tells nations they must “manage” liability for these hastily produced pandemic drugs and vaccines. Decoded, this means that manufacturers, WHO and government officials must be held harmless for injuries from the hastily made products that WHO will help produce. Does it seem like nations are retaining control of the approval processes for pandemic products? Are they in control of the liability provisions? The WHO is telling them what they must do. Nations are expected to follow the WHO’s orders if they sign on to the treaty and/or amendments. However, because nations are told they themselves must pass such laws, the WHO claims the nations have retained sovereignty. And WHO says so with its forked tongue in Article 3, paragraph 2: Sovereignty – States have, in accordance with the Charter of the United Nations and the general principles of international law, the sovereign right to legislate and to implement legislation in pursuance of their health policies.
